Welcome to Silk. These Terms of Service (“Terms”) govern your access to and use of the Silk platform, including our website at silk.cx, our mobile applications, our browser extension, and any related products, features, or services we offer (collectively, the “Services”). The Services are provided by Silknode Software Company, a Delaware corporation doing business as Silk (“Silk,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Notice (available at https://silk.cx/privacy). If you do not agree, do not access or use the Services.

These Terms contain a binding arbitration clause and a class action waiver in Section 19. Please read them carefully.

1. Eligibility

You must be at least 18 years old to create an account or use the Services. By using the Services, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

You also represent and warrant that you are not located in, and are not a resident of, any country subject to comprehensive United States economic sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not listed on any U.S. government list of restricted or prohibited parties, including the Treasury Department’s Specially Designated Nationals List or the Commerce

Department’s Denied Persons or Entity Lists. You agree to comply with all applicable export control and sanctions laws in your use of the Services.

The Services are not directed to children under 18, and we do not knowingly collect personal information from anyone under 18. If we become aware that a user is under 18, we will deactivate the account and take reasonable steps to delete their information.

2. Beta Services

Silk is currently in private beta and is provided on a waitlist-gated basis with rolling invitations. You acknowledge and agree that:

• The Services are pre-release software and may contain bugs, errors, incomplete features, and other issues.
• We may add, modify, suspend, or discontinue any feature, function, or aspect of the Services at any time without notice.
• We do not provide any service level commitments, uptime guarantees, or formal support during the beta period.
• Data, content, accounts, and configurations may be reset, modified, or lost during the beta, and we recommend retaining independent copies of any content you consider important.
• Access is granted at our discretion. We may revoke beta access at any time, with or without cause.

The Services are provided “as is” and “as available” during beta, and the disclaimers and limitations of liability in Sections 14 and 15 apply with full force.
